As it became known to «Caucasian unit» correspondent, the Ministry of Internal Affairs of Kabardino-Balkaria had submitted in Nalchik town court a statement of claim «about protection of professional reputation and indemnification of moral harm». Journalist of «New Gazette» Anna Politkovskaja and lawyer Irina Komissarova were named respondents.
As occasion for the claim Politkovskaja’s article published in №87 «Nalchik a Month Later. The Way Investigation Goes” served that in the claimants’ opinion, contained facts «are mismatching reality, invented and in that way discredit professional reputation of the Ministry of Internal Affairs of KBR».
Facts, discrediting professional reputation of the Ministry of Internal Affairs of KBR, authors of the claim specified information on tortures of arrested persons. «The author of the article in the first paragraph approves that the main methods of the investigating process of the events taken place in Nalchik on October 13-14th, 2005 are tortures.
Militia does not have any other methods… Militiamen are not capable to do any intellectual and professional work, now do everything «to appoint guilty». In the opinion of the authors of the judicial claim, «this data have no anything in common with the real state of affairs, have an obvious provocative character».
In the text of the claim they also declared that neither the author of the article, nor a source of the information — lawyer Komissarova, did not point any proofs of «their fabrications».
As to lawyer Komissarova she was a person interested in that her client could escape fair punishment. Approving, that the Ministry of Internal Affairs of KBR » is strictly guided by Constitution of Russian Federation and KBR and even «by the conventional norms of the international law», the claimants asked court to recognize mismatching reality information published in № 87 of «New Gazette» and to oblige the respondents to publish corresponding refutation (they named some concrete phrases demanding refutation).
Besides the claimants insisted on collecting from the respondents indemnification for moral harm they had estimated in one million rubles.
Note: about tortures by employees of the law enforcement bodies of Kabardino-Balkaria against suspected persons it was written by not only «New Gazette»: in Internet several tens photos of the arrested persons with signs of thrashings on faces had been published. Many people in Nalchik have them.
