On January, 13th, the cassation board of the Supreme Court of Kabardino-Balkaria considered complaints of the lawyers (defenders of the arrested persons) disqualified from the criminal proceeding concerned the attack power structures in Nalchik, IА REGNUM correspondent reported. The judicial board had given up to all three lawyers in satisfaction of their complaints and restoration of the lawyers’ status in the criminal case. The lawyers stated about their intention to address the European court for protection of their rights.
As IА REGNUM correspondent reminded, on November, 10th, 2005 lawyers Irina Komissarova, Inna Golitsyna and Larissa Dorogova according to the inspectors’ decision were discharged of their cases after they had been interrogated under their own complaints. The lawyers’ complaints contained the facts about infringements of their rights, beatings and tortures their clients had been exposed during interrogations. As witnesses investigators considered interrogation incompatible with lawyer powers. In the lawyers’ opinion, the interrogation was a special dodge for their discharge from the cases, preventing of their access to the materials of the cases and meetings with their clients.
The former clients of the discharged lawyers were charged under five clauses of the criminal code: item 205th (terrorism), 209th (gangsterism), 317th (attack law-enforcement structures), 105th (murder), 222nd (illegal purchase and storage of weapon).
